CDM
The Construction (Design and Management) Regulations 2007 (CDM 2007) came into force on 6th April 2007, replacing the original 1994 version of the regulations.  CDM 1994 had always been controversial, due to many duty holders believing that the regulations to be complex and bureaucratic. A construction industry wide consultation was carried out in 2002, which led to the Health and Safety Commission deciding to replace the CDM 1994. The new CDM 2007 regulations have simplified construction legislation by bringing together the Construction (Design and Management) Regulations 1994 and Construction (Health Safety and Welfare) Regulations 1996 (CHSW 1996)  into one single regulation.

Am I the Client?
If you are having construction or building work carried out as part of their business. You could be an individual, partnership or company and includes property developers or management companies for domestic properties.

When does CDM apply?
The principals of CDM 2007 apply to all construction work with the exception of work carried out for a domestic client.

When is a project notifiable?
When construction takes more than 30 construction days or 500 man-days, the project becomes notifiable to the HSE.  A CDM Co-coordinator (CDM-C) and Principal Contractor must be appointed at the appropriate times.

What is the role of a CDM Coordinator?
The CDM-C has a number of key actions to carry out.

  • The HSE must be notified as soon as is practicable after appointed.
  • Provide advice regarding construction health and safety risk matters to the client. 
  • Assist and advice the client with the appointment of competent contractors;
    and whether their management arrangements are adequate. 
  • Ensure that there is good communication, co-operation and co-ordination of information
    between all members of the project team and the preparation of the health and safety file.
