The Control of Asbestos Regulations 2006

The Control of Asbestos Regulations came into force on 13 November 2006 (Asbestos Regulations - SI 2006/2739)
The major changes are as follows:

  • Single Control Limit of 0.1 f/ml for work with all
    types of asbestos.
  • Specific mandatory training for all trades liable to
    be exposed to asbestos.
  • Fibre counting under new World Health Organisation
    (WHO) method, from European Reference Method (ERM).
  • Deregulation of textured coatings

The Approved Codes of Practice ‘Work with asbestos insulation, asbestos coating and asbestos insulating board’ L28 (Fourth Edition) 2002, ‘Work with asbestos which does not normally require a license’ L27 (Fourth Edition) 2002, and ‘A guide to the Asbestos (Licensing) Regulations’ L11 have all been superseded by a new Approved Code of Practice ‘Work with materials containing asbestos’ L143. The management of asbestos in non-domestic premises - L127 2002, in relation to Regulation 4 will still be applicable.

By Law you must have an asbestos management plan such as that provided by an asbestos survey conducted on any non-domestic property that is over 10 years old. OK, but what’s the worst that can happen if you don’t comply with the law?

  • Closure of the premises
  • Personal fines of up to £20,000
  • Disqualification from Directorship
  • A custodial sentence

Asbestos Survey
We are a group of independent Asbestos Surveyors carrying out Asbestos Survey work to help companies comply with the recently up-dated asbestos survey legislation “Control of Asbestos in the Workplace” 2006.

All of our staff who carry out Asbestos Surveys are qualified to the appropriate level to produce an Asbestos Building Survey under the current regulations.

Within an asbestos survey an asbestos surveyor must identify all materials either thought to contain asbestos or ones which could be mistaken for asbestos.

As of January 2010 there are two types of asbestos survey, “Asbestos Management Survey” (formally Type 2) and “Asbestos Refurbishment and Demolition Survey” (formally type 3)

Each one fits a relevant situation, the most commonly carried out by an asbestos surveyor UK is a asbestos management survey whereby in addition to a complete survey of the building any suspect materials are tested in a laboratory to determine the presence of asbestos.

Asbestos Awareness Training
At OJ Safety we hold two types of "Asbestos Awareness Training" courses which cover all the “need to know” points in the new 2006 legislation.

We have developed an easy to understand Asbestos Awareness Training course which is relevant to both your health and safety professional and an on-site worker.

Our Asbestos Awareness Training can be delivered in your own offices or on site to minimise loss of work time or if large numbers are involved in a suitable venue.

Everybody attending our Asbestos Awareness Training will get full course notes for future reference and a certificate of attendance.

It has been our experience over the last few years that operative’s sub-contracting for the larger organisations have to prove attendance at a suitable Asbestos Awareness Training UK course.

With insurance companies being ever more demanding of the level of competence of the workers or sub-contractors their clients employ, proof of Asbestos Awareness Training UK is a must have piece of paper.

OJ Safety offers two types of asbestos awareness training, as follows:
Traditional Asbestos Awareness in the classroom environment. This course consists of half a day at our venue. We also offer in house training if you have a sufficient number of employees you would like training.

Online course this course can be undertaken at your convenience from home or office. The course will take anywhere from 1 hour to 3 hours dependant upon previous knowledge and experience. The need for Asbestos Management of your premises will be covered in our Asbestos Management Plan; each one is site specific to fit your particular building.

Our Asbestos Risk Management report will show you and your staff all aspect of what is required for safe Asbestos Management.

It is laid out in an easy to understand format showing each individual point in your building where asbestos exists and what Asbestos Management is required to keep it safe.

It further shows all the areas of asbestos on a site plan so outside workers who may not be totally familiar with your site will be able to identify their position and carry out the appropriate asbestos management efficiently and safely.
